Governor Kotek invokes Emergency Conflagration Act for Elk Fire in Klamath County as wildfire threat grows
Oregon – Governor Tina Kotek has invoked the Emergency Conflagration Act in response to the Elk Fire burning in Klamath County, as growing threats to life, property, and safety surpass local firefighting capabilities.
The declaration, issued under Oregon Revised Statutes 476.510 to 476.610, came at the request of the Klamath County Fire Defense Board Chief. The Oregon State Fire Marshal (OSFM) agreed with the assessment that the fire poses a significant risk and requires additional support.
The act enables OSFM to mobilize structural firefighting resources through the Oregon Fire Mutual Aid System. The Elk Fire is currently threatening structures in both Klamath and Lake counties, and the declaration applies exclusively to this incident.
Five structural task forces are being deployed to the scene. Two are expected to arrive by Wednesday evening, with three more scheduled to arrive early Thursday morning. A unified command is being established between the Red Incident Management Team and the Oregon Department of Forestry’s Incident Management Team 1, with a briefing planned for Wednesday evening.
The Klamath County Sheriff’s Office is leading evacuation efforts in affected areas. Residents are urged to stay alert, monitor official evacuation notices, and prepare to act quickly.
This is the fourth time Governor Kotek has invoked the Emergency Conflagration Act during the 2025 wildfire season, underscoring the growing severity of fire conditions across the state.
